By booking a tour with Lake Como Explorer Srl. (“LCE”), you (“the Client”) acknowledge and agree to be bound by these Terms and Conditions. These Terms and Conditions apply to all bookings made through LCE, whether directly or indirectly through an agent or third party.
2. BOOKING AND PAYMENT
A. To secure a booking, the Client must provide the required information and pay a non-refundable deposit or the full amount, depending on the booking conditions. The Client will receive a booking confirmation by email from info@lakecomoexplorer.it.
B. Full payment is due no later than 30 days prior to the tour departure date. If the booking is made within 30 days of the departure date, full payment is required at the time of booking.
C. If the Client fails to pay the balance by the due date, LCE reserves the right to cancel the booking, retain the deposit, and apply cancellation charges as outlined in these Terms and Conditions.
3. CANCELLATION BY THE CLIENT
A. The Client may cancel their booking at any time by providing written notice to LCE at info@lakecomoexplorer.it.
B. The following cancellation charges will apply:
i. More than 24 hours before the tour departure schedule: no charge, the Client will receive a full refund.
ii. 24h or less before the tour departure schedule: no refund, the Client will be charged 100% of the tour price.
iii. In the event of a cancellation at any time, the cost of the ‘Villa del Balbianello’ tickets is non-refundable. This amount will be deducted from any refund due as per the above conditions.
C. No refunds will be given for any unused services or inclusions on the tour.
A. LCE reserves the right to cancel a tour due to insufficient bookings or other unforeseen circumstances. In such cases, the Client will be notified prior to the tour departure date and will be offered a full refund or the option to reschedule their tour.
B. LCE is not responsible for any incidental expenses incurred by the Client as a result of the booking, such as visas, vaccinations, or non-refundable flights, and so on.
5. CHANGES TO ITINERARY
LCE reserves the right to change the tour itinerary due to unforeseen circumstances or for the safety and enjoyment of the Clients. LCE will make reasonable efforts to adhere to the published itinerary but may make changes at its sole discretion.
A. The tour price includes all services and inclusions as outlined in the tour description on the LCE website, lakecomoexplorer.it.
B. The tour price does not include flights, visas, travel insurance, gratuities, personal expenses, or any services not expressly stated in the tour description.
C. LCE reserves the right to adjust tour prices due to changes in exchange rates, taxes, or other factors beyond its control.
To ensure the safety and protection of the Client during the tour, LCE requires that the Client obtains comprehensive travel insurance that includes coverage for medical expenses, repatriation, cancellation, and personal liability. The Client assumes full responsibility for obtaining and carrying valid proof of insurance coverage that meets these requirements, without any obligation to present it to LCE.
LCE does not assume any responsibility or liability for any injury, illness, or mishap that may occur during the tour. The Client acknowledges and agrees that LCE shall not be held liable for any costs or losses incurred as a result of their failure to obtain adequate travel insurance coverage, regardless of the cause.
This policy is legally binding and serves as a formal agreement between LCE and the Client regarding travel insurance coverage for the tour. By participating in the tour, the Client acknowledges and agrees to comply with this policy and to bear sole responsibility for obtaining adequate insurance coverage.
8. PASSPORTS AND VISAS
The Client is responsible for ensuring that they have a valid passport, any necessary visas, and any required vaccinations for their tour. LCE is not responsible for any costs, delays, or other consequences arising from the Client’s failure to obtain the required documentation or vaccinations.
9. HEALTH AND FITNESS
A. The Client must be in good health and have an adequate level of physical fitness to participate in the tour. Any medical conditions, disabilities, or other factors that may affect the Client’s ability to participate in the tour must be disclosed to LCE at the time of booking. B. LCE reserves the right to decline a booking or remove a Client from a tour if, in its sole discretion, it determines that the Client’s health or fitness may jeopardize their safety or the safety of others on the tour.
10. CLIENT RESPONSIBILITY
A. The Client is responsible for respecting the laws, customs, and traditions of the countries visited during the tour. LCE may remove a Client from the tour if their behavior is deemed disruptive, offensive, or dangerous to others.
B. The Client is responsible for any damage or loss caused by them to LCE’s property or that of its suppliers. The Client will be required to pay for any repairs or replacements as necessary.
11. LIABILITY AND INDEMNITY
A. LCE and its suppliers shall not be liable for any loss, damage, injury, illness, or death resulting from any act, omission, or negligence of the Client or any third party.
B. The Client agrees to indemnify and hold harmless LCE and its suppliers from and against all claims, actions, losses, damages, and expenses, including legal fees, arising out of or in connection with the Client’s participation in the tour.
LCE shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions if such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, or any other cause beyond the control of LCE.
A. Any complaints about the tour or the services provided by LCE must be made in writing and submitted to LCE at info@lakecomoexplorer.it within 7 days of the tour completion.
B. LCE will make reasonable efforts to address and resolve any complaints. If the Client is not satisfied with the resolution, any disputes arising out of or in connection with these Terms and Conditions shall be governed by Italian law and subject to the exclusive jurisdiction of the Italian courts.
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
These Terms and Conditions, together with the booking confirmation and any other written communications between LCE and the Client, constitute the entire agreement between the parties and supersede all prior understandings, agreements, or representations, whether written or oral, relating to the subject matter hereof.
LCE reserves the right to amend these Terms and Conditions at any time without notice. The Client’s continued participation in the tour shall be deemed acceptance of any such amendments.
A. LCE is committed to protecting the privacy of its clients. Personal information collected during the booking process will be used solely for the purpose of providing the services requested and managing the tour.
B. LCE may share the Client’s personal information with its suppliers, agents, and partners as necessary to provide the services requested. LCE will not sell or rent the Client’s personal information to third parties for marketing purposes.
C. By booking a tour with LCE, the Client consents to the collection, use, and disclosure of their personal information in accordance with LCE’s Privacy Policy, which can be found on the website lakecomoexplorer.it.
A. LCE and its representatives may take photographs and/or videos of the tour for promotional purposes. By participating in the tour, the Client grants LCE the right to use their likeness, image, and voice in any photographs, videos, and marketing materials, without compensation or further notice.
B. The Client is responsible for obtaining any necessary permissions and releases from other tour participants before taking their photographs or recording video footage.
A. Travel insurance is not included in the tour price. LCE strongly recommends that the Client purchases comprehensive travel insurance to cover personal injury, medical expenses, loss of luggage, and expenses associated with trip cancellation or interruption.
B. The Client is responsible for ensuring that their travel insurance policy meets their needs and covers all activities included in the tour.
A. LCE may use third-party suppliers to provide services during the tour, such as transportation, accommodations, and guided excursions. These suppliers operate independently of LCE and are subject to their own terms and conditions.
B. LCE is not responsible for any acts or omissions of third-party suppliers, nor for any loss, damage, injury, or death resulting from the use of their services.
No failure or delay by LCE in exercising any right, power, or remedy under these Terms and Conditions shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or remedy preclude any other or further exercise thereof or the exercise of any other right, power, or remedy.
The headings used in these Terms and Conditions are for convenience only and shall not affect the interpretation of the provisions hereof.
23.APPLICABLE LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the laws of Italy. Any dispute arising out of or in connection with these Terms and Conditions, including any question regarding their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Como, Italy.
24. CHANGES TO TERMS AND CONDITIONS
LCE reserves the right to update or modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on lakecomoexplorer.it. The Client’s continued participation in the tour or use of LCE’s services constitutes their acceptance of the revised Terms and Conditions.
